The license required the customer to return the product within a limited time frame if the license had not been agreed. In Brower, the New York State Court of Appeals held that the conditions of the reduced licence document applied, since the customer`s consent is evident in the fact that the goods are not returned within 30 days of the document. The U.S. District Court of Kansas in Klocek decided that the sales contract had been entered into at the time of the transaction, and the additional delivery conditions in a document similar to Brower`s were not a contract, as the customer never accepted them when the sales contract was entered into. A common example occurs when a user has to accept a website`s licensing terms by clicking “Yes” in a pop-up to access the site`s features. This is therefore an analogy with retractable wrap licenses, for which a buyer implicitly accepts the licensing conditions by first removing the retractable film from the software and then using the software itself. For both types of analysis, the focus is on the actions of the end user and asks whether the additional licensing conditions are explicitly or implicitly accepted. In most cases, an AU will attempt to keep the licensee unscathed if the software causes damage to the computer or user data, but some software also suggests limiting whether the licensee can be held liable for damage caused by inappropriate use of the software (for example). End-user licensing agreements were also criticized for containing conditions that impose incriminating obligations on consumers. For example, Clickwrapped, a service that evaluates consumer companies on the basis of respect for users` rights, indicates that they increasingly contain a term that prevents a user from suing the company.  Through the installation and use of the software, you declare and guarantee that you have the ability and jurisdiction to enter into a binding agreement to comply with the terms of this license and that the software will only be used in accordance with the terms of this license and with all applicable laws. Whether Shrink-Wrap licences are legally binding varies from one legal system to another, although most jurisdictions have these licences to be enforceable.
